Bryan Carmody: First Amendment Debate


On Friday January 24 2020, police raided the home of a San Francisco freelance reporter,
Bryan Carmody, using a sledgehammer. They arrived at his house at about 8 a.m. & started
hitting the front gate of his home. Once the officers had a search warrant, they searched
the home top to bottom in order to find a confidential police report that was leaked about the
death of Jeff Adachi, who was the city's public defender.

Two weeks prior, the police came to his home to ask for the source that gave him the
information, but he refused. He claimed, "There's only two people on this planet who know
who leaked this report- me & the guy who leaked it,". While the officers searched his house
and found the case notes, Carmody was held at the police department from 8:22 a.m. to
1:55 p.m. The police claimed that the notes were stolen/embezzled property. 


After the incident, many people believed that this was a violation of the First Amendment.
They believe that since Carmody had the information, he has the right to do what he will with
it. I also believe that Carmody should have the right to share this information. As a reporter,
his job is to get the scoop on topics that are not well known to the world. Reporters often get
in trouble for sharing things they do not have “consent” to share, however the First
Amendment contradicts this unspoken rule.
